Partner Terms

1. Overview

These Partner Terms ("Terms") describe the general terms that apply to prospective and approved partners of ACG United ("ACG," "we," "us" or "our"). These Terms are supplemented by, and in the event of conflict are superseded by, any signed partner or agent agreement between you and ACG United.

2. Eligibility

To be considered as an ACG United partner, an applicant must provide accurate and complete information during the application and qualification process and meet any eligibility criteria applicable to the products, services or provider programs the applicant is interested in offering.

3. Application and Qualification

Submission of a partner application does not guarantee acceptance into any ACG United partner or provider program. ACG United will review submitted applications and may request additional information before making a determination. ACG United may accept, decline or condition acceptance of any application in its sole discretion.

4. Partner Relationship

Unless otherwise expressly stated in a signed written agreement, any relationship between ACG United and a partner is that of independent contractors. Nothing in these Terms or on this website creates a partnership, joint venture, franchise, agency or employment relationship between ACG United and any partner.

5. Commissions and Compensation

Commission structures, payment terms and related compensation details, where applicable, will be set forth in a separate written partner or agent agreement and are not established by these Terms or by this website.

6. Confidentiality

Partners may receive confidential or proprietary information from ACG United or its provider partners in connection with the partner relationship. Partners agree to use such information solely in connection with the partner relationship and not to disclose it to third parties except as permitted under a signed written agreement.

7. Compliance with Law and Provider Requirements

Partners are responsible for complying with all applicable laws and regulations, as well as any carrier, provider or program-specific requirements associated with the products or services they market or sell in connection with ACG United, including applicable telemarketing, SMS/text messaging and data privacy laws.

8. Term and Termination

ACG United may suspend or terminate a partner relationship at any time in accordance with the terms of the applicable written partner agreement or, in the absence of a written agreement, upon notice, for any lawful reason, including a violation of these Terms, ACG United's Acceptable Use Policy, or applicable law.

9. Limitation of Liability

To the fullest extent permitted by applicable law, ACG United will not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to the partner relationship or use of the Services.
